Creator terms of service

1. GENERAL ACCEPTANCE. In subscribing to the Creatable platform, as a creator ("Creator"), you agree to be bound by these terms and conditions of service (the “Terms of Service”). The Creatable platform, products, software, and applications are collectively referred to as “Service” in these Terms of Service, forming a binding agreement between you and Creatable.

2. ELIGIBILITY. Creatable is open to anyone who is sixteen (16) years of age or older (or of age required under applicable law) at the time of signing up. Whether someone is eligible shall be subject to the sole discretion of a brand (a "Brand"), as further outlined below.

3. LICENSE & USE OF SERVICE. You are hereby granted a license to use the Service in accordance with, and subject to, these terms and conditions, perpetually and limited for any period of time that may be determined by Creatable. The Service, including trademarks, service marks and logos are all owned by or licensed to Creatable, and/or subject to copyright and other intellectual property rights under law. By using the Service, you are granted a non-exclusive, revocable, and limited license to use the Creatable trademark, logos and related marks (“Creatable Marks”) solely as used within and as part of the Service.

‍4. BRAND CREATOR PROGRAMS & CAMPAIGNS. A brand may run a creator program on the Creatable platform (a “Brand Creator Program”). Creators may be eligible to participate in such Brand Creator Program, as shall be determined by the Brand. A brand may also run a Creator campaign and may invite a Creator to participate ("Creator Campaigns"). Brand Creator Programs and/or Creator Campaigns may incorporate terms and conditions set forth in such Programs and/or Campaigns and agreed to by you, and in such case shall apply in addition to these terms. The Brand may also offer commission and other payments or incentives for promoting the brand and/or a particular product or service carried by such brand.

‍5. DISCLOSURE THAT YOU ARE GETTING PAID. In all posts and communications made by you in connection with any Brand Creator Program or Creator Campaign, you will ensure to communicate to your audience and all recipients of such posts and communications that you may receive compensation resulting from such posts and communications. Creator agrees to refrain from removing or deleting any social media post made in accordance with any of the foregoing for a period of at least 90 days from the original post date.

‍6. PAYMENT. You may be entitled to payment subject to satisfying the conditions of a Creator Campaign and/or a Brand Creator Program. To collect payment via the Creatable platform, you must fill in all required information in your account, as further detailed in the article “set up your payment information” on the Creatable support site (see here). ‍7. CONFIDENTIALITY. In preparing for and contributing to a Creator Campaign or any Brand Creator Program, you may have access to information relating to the affairs of the Brand and acknowledge and agree that all such information, unless it is already available to the general public without restriction, is the Brand's confidential and proprietary information ("Confidential Information") and cannot be disclosed other than as set forth in the Creator Campaign or Brand Creator Program.

8. USAGE RIGHTS. As part of any Creator Campaign or Brand Creator Program, usage rights that you grant for the Brand to make use of your content may be set forth by the Brand and agreed to by you in a campaign brief or program terms. In the absence of any such terms to the contrary, you hereby grant the Brand the rights to use your content on their website and their social properties, strictly in accordance with the spirit of marketing the brand, products and/or services associated with such campaign or program. Unless you specifically grant additional rights to the Brand, no rights are granted to Brand to use your Campaign or Program content, likeness, name or any of your other content in any manner whatsoever.
